Terms of Use
These terms cover the apps Pronghorn Labs publishes and this website, pronghornlabs.net. Pronghorn Labs is the name under which Prairie Fire, LLC (“we”, “us”), a Colorado limited liability company, makes apps and does software consulting. If an app has its own terms, such as Cephas, those govern that app. Consulting and development work we do for clients is governed by the agreement for that engagement, not by these terms.
The apps
Our apps are distributed through Apple’s App Store and TestFlight. Unless an app’s App Store page shows a different agreement, your use of it is governed by Apple’s Licensed Application End User License Agreement, under which the app is licensed, not sold, to you. These terms add to that agreement. Where the two disagree, Apple’s agreement wins, and nothing here takes away any right it or the law gives you.
Apps on TestFlight are unfinished. They may change, lose data or stop working, and a test version expires when Apple says it does.
Purchases and subscriptions
Some apps offer in-app purchases or subscriptions. Apple sells them, takes payment, and handles renewals, cancellations and refunds under its own terms. A subscription renews automatically until you cancel it in your Apple Account settings; cancel at least a day before the renewal date to avoid being charged for the next period. Free trials become paid subscriptions when they end unless you cancel first. What a purchase unlocks is described in the app at the point of sale.
Your content
What you create or keep in our apps is yours. We claim no rights in it. Our apps keep it on your devices, and in your own iCloud where an app syncs, so we never receive it unless you choose to send it to us, for example in an email.
Apple and other services
Some apps work through services run by others: iCloud, Messages, Apple Weather, HomeKit, or websites you add yourself. Those services are provided under their own terms and policies, and we are not responsible for them.
Acceptable use
You agree to use our apps and this site within the Acceptable Use Policy, which is part of these terms.
Our names and icons
Pronghorn Labs, the names of our apps and their icons belong to Prairie Fire, LLC. Please don’t use them in a way that suggests we made, endorse or support something we didn’t.
Not affiliated
Our apps are independent tools. Unless an app says otherwise, they are not affiliated with, authorised by or endorsed by Apple or by any organisation whose meetings, materials or community an app is designed to serve.
No warranty
Our apps and this website are provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows. We work to keep them accurate and dependable, but we don’t promise they will be uninterrupted or free of errors. Keep your own copies of anything that matters.
Limitation of liability
To the fullest extent the law allows, Prairie Fire, LLC is not liable for indirect, incidental, special or consequential loss, including lost data, arising from your use of our apps or this website, and our total liability for any claim is limited to the amount you paid for the app or purchase concerned in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.
Governing law
These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law rules, except where the law of the place you live gives you protections that cannot be waived.
Changes
If these terms change, the new version will be posted here with a new date. Continuing to use an app after a change means you accept the new terms.
